Lease with Purchase Option



Remarkable changes have taken place in today's real estate landscape significantly eclipsing the way we have done business in the past.  An example of this change is the "Lease with Purchase Option."  In an effort to immediately mitigate short-term losses of unoccupied space, Landlords are now more frequently providing Tenants lease provisions commonly referred to as an Option to Purchase.  The Option to Purchase allows a tenant to convert its leasehold interest to fee simple ownership at certain pre-determined times during the course of there lease term.  There are significant tax benefits associated with this new form of ownership.* 

It is not uncommon to have the exercised purchase price established at "current appraised value".  The challenge however is timing.  Should market prices significantly increase during the lease term due to an uptick in the market cycle, purchasing the property may be unrealistic.  However, with proper brokerage representation the scenario does exist wherein the purchase price can be agreed upon based on today's market values.
